1. Agreement to Terms

By downloading, installing, or using West (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

West is operated by TheStudio, LLC ("we," "us," or "our"). These Terms constitute a legally binding agreement between you and TheStudio, LLC.

Eligibility. The App is rated 4+ on the Apple App Store and may be used by all ages. By using the App on behalf of a minor, a parent or legal guardian represents that they have reviewed and agreed to these Terms on the minor's behalf.

Arbitration Notice. These Terms contain a mandatory arbitration agreement in Section 13. Please read it carefully. It requires that most disputes be resolved through binding arbitration rather than in court, and limits your ability to bring class action claims. You may opt out as described in Section 13.

2. License to Use the App

Subject to your compliance with these Terms, TheStudio, LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by Apple's App Store Terms of Service.

This license does not include the right to:

Modify, reverse engineer, or create derivative works of the App
Sublicense, sell, or transfer your rights to the App
Remove any proprietary notices or labels on the App
Use the App for any unlawful or unauthorized purpose

3. Subscriptions & In-App Purchases

3.1 West Pro

West offers West Pro, a subscription that unlocks all presets, effects, and controls. Current pricing and plan details are displayed in the App and in the App Store listing. West Pro is available as a monthly or yearly auto-renewing subscription.

3.2 Free Trial

We may offer a free trial period for new West Pro subscribers. At the end of the free trial, your subscription will automatically begin and you will be charged unless you cancel before the trial period ends. Only one free trial is available per Apple ID.

3.3 Billing & Renewal

Subscriptions are billed through your Apple ID. Your subscription will automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

3.4 Cancellation

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period — you will retain access to West Pro features until that date. We do not provide refunds for unused portions of a subscription period.

3.5 Lifetime Purchase

We may offer a one-time West Pro Lifetime purchase. Users who have purchased West Pro Lifetime will retain access to the features available at the time of purchase for the lifetime of the App.

3.6 Price Changes

We reserve the right to change subscription pricing. You will be notified of any price changes in advance and will have the opportunity to review and accept the new price before it takes effect.

4. User Content

West allows you to capture, edit, and store photos and videos ("User Content"). You retain all ownership rights to your User Content.

By using the App, you grant TheStudio, LLC a limited, non-exclusive license to store and process your User Content solely as necessary to provide the App's features and services. We do not claim ownership of your photos or videos, and we do not use them for advertising or share them with third parties without your consent.

You are solely responsible for any User Content you create, store, or share using the App. You agree not to use the App to create or store content that:

Violates any applicable law or regulation
Infringes on the intellectual property rights of others
Contains illegal, obscene, or harmful material
Violates the privacy or rights of any third party

Sharing to Third-Party Platforms

The App may allow you to share User Content to third-party platforms such as Instagram. Once you share content to a third-party platform, that content becomes subject to that platform's terms of service and privacy policy. You are solely responsible for the content you choose to share and for complying with the rules of any platform you share to. TheStudio, LLC is not responsible for how third-party platforms handle, display, or distribute content you share with them.

5. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://west.download/privacy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in our Privacy Policy.

6. Intellectual Property

The App, including its design, graphics, presets, effects, features, and underlying technology, is owned by TheStudio, LLC and is protected by copyright, trademark, and other applicable laws. All rights not expressly granted to you in these Terms are reserved by TheStudio, LLC.

7. Copyright & DMCA

We respect the intellectual property rights of others. If you believe that content accessible through the App infringes your copyright, you may submit a notice to our designated agent with the following information:

A description of the copyrighted work you claim has been infringed
A description of where the allegedly infringing material is located within the App
Your contact information (name, address, phone number, and email)
A statement that you have a good faith belief that the use is not authorized by the copyright owner
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
Your physical or electronic signature

We will respond to valid notices in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THESTUDIO, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless TheStudio, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your access to or use of the App
Your User Content
Your violation of these Terms
Your violation of any applicable law or the rights of any third party

11. Apple App Store Terms

These Terms are entered into between you and TheStudio, LLC, not with Apple, Inc. Your use of the App is also subject to Apple's Standard End User License Agreement (EULA), which applies in addition to these Terms. In the event of any conflict between these Terms and Apple's EULA, Apple's EULA will govern solely with respect to Apple's role as the distributor of the App.

Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for the App. To the extent that a warranty applies, Apple has no warranty obligations. Apple is not responsible for addressing any claims relating to the App or your use of the App.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, through a notice in the App. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.

13. Dispute Resolution & Arbitration

Informal Resolution. Before filing any formal claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days.

Binding Arbitration. If the dispute is not resolved informally, you and TheStudio, LLC agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms or the App through binding individual arbitration, rather than in court. This includes any claims that arose before you accepted these Terms.

Arbitration shall be administered by a recognized arbitration provider (such as JAMS or AAA) under its applicable rules. The arbitration will take place in Colorado, or at a mutually agreed location. The arbitrator's decision will be final and binding.

No Class Actions. You may only bring claims against TheStudio, LLC in your individual capacity, and not as a plaintiff or class member in any class action, class arbitration, or representative proceeding.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.

Exceptions. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims that by law cannot be subject to arbitration are excluded from this section.

14. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without notice, if we believe you have violated these Terms or for any other reason. Upon termination, your license to use the App will immediately cease.

15. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. To the extent a dispute is not subject to arbitration under Section 13, you agree to submit to the exclusive jurisdiction of the state or federal courts located in Colorado.
